Pre-Contract

  • Preparing and negotiating standard form and bespoke construction and engineering contracts, tailored to the commercial realities of each project–upstream and downstream.
  • Comprehensive contract reviews and risk analysis, including the development of departures matrices aligned to client risk appetite and project objectives.
  • Legal support throughout the tender and procurement phase to improve positioning, allocate risk effectively and avoid legacy issues during delivery.

  • Managing live disputes, including Security of Payment claims and related processes during active project delivery.
  • Building and executing strategic pathways to resolve contested issues efficiently, while maximising commercial and legal outcomes.

Post-Contract

Litigation and dispute strategy to resolve issues, preserve value and protect reputation

  • Acting in all forms of dispute resolution, including litigation, mediation, arbitration, reference hearings and expert determination across all jurisdictions in Australia.
  • Advising and representing clients in Security of Payment disputes, including adjudications and enforcement.
  • Managing complex claims relating to delay, disruption, loss of productivity, variations, latent conditions, liquidated damages and cost escalation.
  • Advising on breach of contract disputes arising during or after delivery, including enforcement of key contractual provisions and recovery actions.
  • Handling residential construction disputes, including matters under the Home Building Act, Design and Building Practitioners Act and Residential Apartment Buildings (Compliance and Enforcement Powers) Act.
  • Representing clients in professional negligence claims involving project consultants, certifiers and engineers.
  • Advising on WHS compliance and defence of prosecutions brought by regulators.
  • Supporting clients with dispute avoidance strategies post completion, to minimise exposure in future engagements or contract finalisation.
