Another Security of Payment Review

The Minister for Employment, the Honourable Michaeli Cash has appointed Mr John M Murray AM to conduct a Federal review of security payment laws in the building and construction industry across Australia. Mr Murray will undertake a wide ranging review in consultation with business, governments, unions and other relevant interested parties. A final report is to be delivered no later than 31 December 2017.

The review will:

1. examine security of payment legislation in all jurisdictions to identify the areas of best practice for the construction industry and also take into account reviews and enquiries that have recently been conducted;
2. consult with business, governments, unions and interested parties and the Security of Payments Working Group*; and
3. consider how to prevent various types of contractual clauses which restrict contractors in the construction industry from obtaining payments for work that has been completed.

The report will include recommendations to the government on any changes.
